Copyright Policy

It is understandable that the whole copyright debacle of "this is fair use", and "this is not fair use", isn't fun, nor is the broken, backwards system that the entire copyright law is in right now, but protecting the artistic work of an artist is vital to ensure originality, openness, creativity and fairness.

 

  • A. Videography Works: any and all original videography works are property of Brendon Thearle and/or his production house; Thearle Films. Any works that are used in the original videographic works that are not solely created by Brendon Thearle will be openly credited and respected by said creator and that no copyright infringement is intended. Any works that are used for client-based works are property of their respectful owners and are only used by the request of the client/s in question and in no way infringe on the original copyright holder. Brendon Thearle and/or Thearle Films are not legally and personally responsible for any works not originally created by said entity. Usage of any and all videographic work created by Brendon Thearle and/or Thearle Films without express permission and consent will be in breach of this copyright policy and may be liable to a takedown request or any further legal action.

 

  • B. Photography Works: any and all original photography works are property of Brendon Thearle. Usage of any and all photographic work created by Brendon Thearle without express permission and consent will be in breach of this copyright policy and may be liable to a takedown request or any further legal action.

  1. Photojournalistic Works: ​some of the photos considered as 'photojournalistic' may have been used by news outlets, sites and portals with consent and full (written) permission. Any unauthorized usage of these photojournalistic materials may be subjected to a takedown request or any further legal action.

  • C. Graphic Design Works: any and all original graphical design works are property of Brendon Thearle. Usage of any and all graphic design work created by Brendon Thearle without express permission and consent will be in breach of this copyright policy and may be liable to a takedown request or any further legal action.

  1. Using Other Graphical Design Assets and Elements: ​some of the altered images were created during lectures on graphic design and/or created for personal training purposes and as such any images used in said altered images may be subject to separate artistic copyrights and in no way are intended to infringe on the original (supposed copyrighted) work. All original images used for the purposes of altering them will be credited, however, not all original images may be able to be credited or credited properly due to limited or unsuccessful searches to find the original artists.

  1. Using Other Works for Portfolio Purposes: ​some of the images/trailers/TVCs/audio recordings were created by third-party individuals and as such any other works used in said portfolio purposes may be subject to separate artistic copyrights and in no way are intended to infringe on the original (supposed copyrighted) work. All original other works used for the purposes of a portfolio will be credited, however, not all original other works may be able to be credited or credited properly due to limited or unsuccessful searches to find the original creators.

  • E. Writing Works: any and all original written works are property of Brendon Thearle. Usage of any and all written work created by Brendon Thearle without express permission and consent will be in breach of this copyright policy and may be liable to a takedown request or any further legal action.

  • F. Blog: any and all original written works featured in the Blog are property of Brendon Thearle. Usage of any and all written work featured in said Blog created by Brendon Thearle without express permission and consent will be in breach of this copyright policy and may be liable to a takedown request or any further legal action.

 

  • G. Your rights: 

  1. G1. you are entitled to request a removal of any and all works (when and if applicable by Maltese (local) and European Union (EU) law) if you appear in said work without consent or permission (such as a photo taken on a public street), however, any requests for removal on a work which was provided to you with (written) permission or consent will not be removed without a reasonable and proper explanation.

  2. G2. the Data Protection Act, 2018 sets down a formal procedure for dealing with such requests, which the operator acknowledges.

  3. G3. all request subjects have the right to access any personal (and metadata) information kept about them by the operator, either on computer or in manual files. Requests for access to personal information by request subjects are to be discussed through the contact page.

  4. G4. the operator aims to comply as quickly as possible with requests for access to personal (and metadata) information and will ensure that it is provided within a reasonable time, unless there is good reason for delay. When a request for access cannot be met within a reasonable time, the reason will be explained to the request subject making said request.

  5. G5. all request subjects have the right to request that their information (including metadata information) be amended, erased or not used in the event the data is incorrect.
